Patent and copyright law Understanding Patent and Copyright Law Patent and copyright law gives the inventor the exclusive rights to the invention. No one else can produce the invention for a set period of time under patent and copyright law. Patent and copyright law is set up to protect inventors. The claims protect the patent owner and notify the public exactly what the individual has patented or owns. If someone infringes upon patent and copyright law, it is usually enforced in a civil court setting. The owner of the patent will generally bring a civil lawsuit against the person who has infringed upon their patent and ask for monetary compensation. In addition, the patent owner can seek an injunction which would prohibit the violator from continuing to engage in any acts that would infringe upon their patent in the future. Many patent owners will make licensing agreements (or contracts) with others. These agreements allow another person or company to use someone’s patented invention in return for royalties. In addition, some patent holders who are competitors may agree to license their patents to each other to expand both of their profits. Most everything we use in our day to day life was invented by someone. That person had to seek out a patent for their invention. Are you taking on more responsibility than you need to, instead of delegating tasks to others? Are you spending a lot of time chatting in the break room when you run for a cup of coffee? Are you procrastinating so that big projects require you to work all-nighters instead of spreading out the work? Keep a journal of all of your activities at work for a few days. You might be surprised to see how you are really spending your time and in what areas you could make improvements. Simply staying on task and delegating effectively could get you home in time for dinner. When you have done everything you can to make your work habits as productive as possible, it is time to turn to other ways to balance your work life and your family life. Rule number one is the hardest one for most people to follow you – draw clear lines of distinction between work time and family time. Family time isn’t really family time if you are constantly on your cell phone making and receiving work calls or if you are on your laptop for the entire family vacation. When you’re working – work. When you’re with your family – concentrate on them. The time you spend actually taking a breather from work will recharge your batteries and make you a better worker when work time rolls around again. Next, you have to evaluate your priorities. Maybe working around the clock will help you make partner faster, but at what cost? Decide if seeing your daughter’s soccer game every week is more important to you than moving up the corporate ladder quickly, and make adjustments in your schedule appropriately. There is no right or wrong answer, but deciding where you priorities lie will make scheduling easier for you. With your priorities in mind, see what work options are available to you to help you meet them. If you want more time with the kids, see if your office offers flex time or part time hours to help you meet your family commitments. Last but not least, don’t feel guilty about taking time with your family. Not only is this time important to your family, you can rest assured that the time out from the office stress will make you more productive when you return to work.

International Copyright Law Surprise! There Is No International Copyright Law Many people are surprised to learn that there is no international copyright law. Yes, that is right. There is not an international copyright law that will protect your work on the other side of the world. However, it is important to note that most countries do offer some form of protection to what is deemed as “foreign” works. International conventions and treaties have done much to protect owners of copyrights around the world. With the world seemingly becoming smaller every day the United States took a look at its stance on the European copyright treaty known as the Berne Convention. Basically, the Berne Convention of 1886 involved European nations coming together to seek a uniform copyright law to keep their copyright owners from having to register for copyrights in individuals European countries. The United States signed on to the Berne Convention introduced made it into a U.S. law known as the Berne Implementation Act of 1988. If you are seeking to have your work protected in a particular country you need to find out what kind of protection foreign authors have in that country. Some countries offer little or not protection to foreign authors. It should be noted that the U.S. Copyright Office is not allowed to give authors recommendations or the names of attorneys or agents that could help them understand foreign copyright laws. However, with a little investigation it is not hard to find someone who is an expert on foreign copyright law. These individuals can help you learn more about copyright protection and how your work is deemed in a foreign country. Someone who works in international copyright law will tell you that it is different than most other sectors of law. It involves knowing the copyright law of two or more countries. Every country has their own way of granting and protecting someone’s copyright. The individual criteria of each country must be taken into consideration when you are dealing with international copyright law. It is important to note that some countries do not have any intellectual property rights and some countries even grant more copyright protections than even the United States.
